Terms and Conditions of Sale

General Provisions

1.1. These e-shop rules (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller (hereinafter – the Seller), which sets out the rights and obligations of the Parties.

1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes to the Rules on the e-shop website.


Conclusion of the Sale and Purchase Agreement

2.1. The sale and purchase agreement between the Buyer and the Seller shall be deemed concluded when the Buyer places and submits an order for goods in the e-shop, having first familiarized themselves with these rules.


Seller's Rights

3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the e-shop without prior notice to the Buyer.

3.2. If the Buyer attempts to undermine the operation, stability, or security of the e-shop or violates their obligations, the Seller has the right to limit or suspend the Buyer's access to the e-shop without warning.

 

Seller's Obligations

4.1. The Seller undertakes to provide access to the services of the e-shop, the operating conditions of which are set out in these Rules.

4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, based on the conditions set out in these sale and purchase Rules.

4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the e-shop, the Seller has the right to terminate the Sale and Purchase Agreement after informing the buyer. The Seller may offer an analogous item. If the Buyer refuses, the Seller undertakes to refund the paid money within 3 business days.

4.4. If the Buyer exercises the right provided in clause 5.2 of the Rules, the Seller undertakes to refund the money paid by the Buyer within 5 (five) business days from the date of receipt of the returned item.

4.5. The Seller may withhold reimbursement until the goods have been returned to the Seller or until the Buyer provides proof of having sent back the goods, whichever is the earliest.

 

Buyer's Rights

5.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Rules.

5.2. The Buyer has the right to withdraw from the sale and purchase agreement concluded in the e-shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.

5.3. The Buyer may exercise the right mentioned in clause 5.2 only if the goods have not been damaged or their appearance has not substantially changed, and if they have not been used.


Buyer's Obligations

6.1. The Buyer must pay for the purchased goods and accept them in the manner provided for in these Rules.

6.2. If the Buyer, during the delivery of the goods, refuses to accept the goods without good reason, the Buyer must cover the costs of returning the goods if requested by the Seller.

6.3. During the delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the item(s) together with the Seller or the person who delivered the shipment.

6.4. By using the e-shop, the Buyer confirms that they agree to these sale and purchase rules and must comply with them.


Prices of Goods

7.1. The prices of goods in the e-shop are stated in euros. Prices are indicated including VAT. After confirming the order, a delivery fee, if applicable, is added to the total amount of the goods.


Ordering and Payment for Goods

8.1. The Buyer, after visiting the e-shop, selects the goods they like and adds them to the shopping cart. After forming the shopping cart, the Buyer enters the personal data necessary for fulfilling the order: their first name, last name, address to which the goods will be delivered, phone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have familiarized themselves with these rules and confirms the order.

8.2. Payment can be made using the electronic banking services of Swed, Seb, Luminor, Citadelė, Šiaulių bankas, and Visa / MasterCard payment cards. Payments are possible in euro currency. Payments are processed using the MakeCommerce.lt payment platform.

 

Delivery of Goods

9.1. The Buyer, when ordering goods, must specify the exact delivery address for the goods.

9.2. The Buyer must accept the goods themselves. If the Buyer cannot accept the goods themselves, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to claim against improper delivery to another person.

9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the product descriptions.

9.4. The characteristics of all sold goods are specified in the description next to each item. The Seller is not responsible for the color, shape, or other parameters of the goods in the e-shop not matching the actual size, shape, and color of the goods due to the characteristics of the Buyer's monitor.

9.5. If the Buyer withdraws from the sale and purchase agreement, all sums paid by them, including the delivery costs paid by the Buyer, shall be refunded to the Buyer.

 

Return of Goods

10.1. Quality goods may be returned within 14 days from the date of their receipt. Defects of sold goods of unsatisfactory quality are remedied, unsatisfactory goods are exchanged, or refunded in accordance with the provisions of the Civil Code of the Republic of Lithuania.

10.2. The following conditions must be observed when returning goods:

10.2.1. The returned item must be in its original undamaged packaging (this point does not apply in the case of returning unsatisfactory goods);

10.2.2. The item must not be damaged by the Buyer;

10.2.3. The item must be unused, not have lost its commercial appearance: labels intact, protective films not peeled off, etc. (this point does not apply in the case of returning unsatisfactory goods);

10.2.4. The returned item must be of the same completeness as received by the Buyer (this point does not apply in the case of returning unsatisfactory goods);

10.2.5. The Seller has the right to refuse to accept goods returned by the Buyer if the conditions for returning goods were not complied with;

10.2.6. Goods are returned in the manner specified by the Seller within 14 (fourteen) days from the date of receipt of the goods (this point does not apply in the case of unsatisfactory goods - in such a case, goods are returned within the statutory warranty period);

10.3. The return and exchange of goods of appropriate quality are carried out in accordance with Article 6.22810, Part 1 of the Civil Code;

10.4. Money paid for goods accepted by the Buyer but subsequently refused shall be refunded to the Buyer's account no later than 5 (five) days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.


Final Provisions

11.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.

11.2. These Rules and the relationship between the Parties in respect of these Rules shall be governed by and interpreted in accordance with the laws of the Republic of Lithuania.

11.3. All disagreements arising from the execution of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

11.4. The Parties shall be exempt from fulfilling obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the will of the Parties (Force Majeure).
